Terms of service
The agreement you accept when you create a Placony account or buy a plan. Plain English on purpose; the plain reading is the intended one.
1. Who this is between
These terms are between Placony ("we", "us") and the business on whose behalf you create an account ("you"). By creating an account you confirm that you are allowed to bind that business. Placony is sold to businesses, not to consumers.
2. What Placony does
Placony is lead-response software. It answers visitors on your website from your own content, captures the ones who leave a phone number and ask to be contacted, places an automated call back to them within about a minute, asks the qualifying questions you configure, books appointments into your calendar, and records all of it in a CRM. You configure what it says; it does not call anyone you have not given it.
It is not a telephone service, a dialler for cold outreach, or a bulk messaging tool, and it cannot be used as one. The calling capacity is metered per workspace and every call requires a stored consent record for the person being called.
3. Your account
- Keep your sign-in details and your team's access under your control. What is done under your account is your responsibility.
- Give us accurate business details, and keep the billing contact current.
- You may invite teammates; each accepts these terms by joining.
4. What you are responsible for
That the people Placony calls agreed to be called. Placony records how each lead asked to be contacted (the form, the page, the time, the IP) and refuses to place an automated call where no such record exists. It cannot know whether your own forms say what they should. Automated calling is regulated, in the United States by the TCPA with statutory damages per call, and elsewhere by similar rules. Getting that wrong is your exposure. If you sell in a regulated market, have a lawyer read the consent wording on your forms before you start.
That what you tell the AI to say is true. It answers from your website and the notes you give it. That you do not upload content you have no right to use. That you comply with the law where you and your leads are.
5. What we are responsible for
- Keeping the service running and your data separated from every other customer's.
- Telling every person the AI calls, in its first sentence, that it is an AI on a recorded line. This cannot be switched off.
- Honouring an opt-out immediately and permanently, and never calling outside the hours you set, measured in the lead's timezone.
- Handling personal data as described in the privacy policy.
6. What you may not use it for
- Calling or messaging people who have not asked to be contacted by you.
- Debt collection, political calling, emergency services, or anything that requires a licence you do not hold.
- Presenting the AI as a human, or impersonating another business or person.
- Collecting payment card numbers, government identifiers, or health information over a call.
- Anything unlawful, deceptive, or harmful. We end an account doing any of these, and forfeit its remaining period.
7. Fees and billing
Plans are priced on the pricing page and billed in advance, monthly or yearly, and renew automatically until you cancel. Each plan includes a set allowance of voice minutes and chat messages. Minutes are billed on the length the carrier reports, rounded up to six seconds. When the allowance is used, outbound calling stops unless you switch on overage, in which case extra minutes are charged at your plan's rate on the next invoice. We will not quietly run up a bill.
Every account starts with a seven-day free trial; a card is required and nothing is charged until the trial ends. Prices are in US dollars and exclude applicable taxes. Payments are processed by Dodo Payments as merchant of record, and its buyer terms apply to the payment itself. We may change prices with 30 days' notice by email; the change applies from your next renewal after that.
8. Cancelling and refunds
Cancel from your billing page at any time; you keep access to the end of the period you paid for. Refunds are governed by the refund and cancellation policy, including a full refund of a first charge requested within 14 days.
9. Your data
Your leads, recordings, transcripts, website content and configuration are yours. You give us the licence needed to run the service on them and nothing more. We do not use one customer's data to improve anything for another, and we do not sell it. You can export your leads as CSV at any time and delete your workspace, which deletes everything in it.
10. Our software
Placony, its interface, its prompts and the embed script remain ours. You may embed the widget on sites you control and may not copy, resell, or reverse-engineer the service.
11. Availability and support
We aim for the service to be available at all times and tell you about planned maintenance in advance. Support is by email at hello@placony.com, answered within 1 business day.
12. Limits on liability
Placony is software; it will sometimes be wrong, and it will sometimes be unavailable. We provide it as is, without warranties beyond those the law does not let us exclude. Our total liability to you for anything arising from these terms is capped at the amount you paid us in the twelve months before the claim. We are not liable for lost profits, lost business, or for the consequences of calls placed to people who had not, in fact, consented.
You will cover us for claims that arise from your breach of section 4 or section 6, including regulatory fines and statutory damages for calls you asked us to place.
13. Ending the agreement
You can end it by cancelling and deleting your workspace. We can end it on notice if you breach these terms, if we are required to by law or by a provider we depend on, or, with 30 days' notice and a refund of any prepaid unused period, if we withdraw the service.
14. Changes
We may revise these terms. Material changes are emailed to the billing contact at least 14 days before they take effect, and the revision date at the top of this page changes. Continuing to use the service after that date accepts the new terms.
15. Law and disputes
These terms are governed by the law of, and any dispute is heard in, the courts of the jurisdiction in which the company is registered. Before either side goes to court, we each agree to try to resolve the matter by discussion for 30 days.
